Estonia makes the withdrawal button mandatory on 1 September — what the TTJA will check

On 1 September 2026 Estonia's amendment to the Law of Obligations Act (VÕS) takes effect, making an on-site withdrawal button mandatory for every online store. It is Estonia's implementation of Directive (EU) 2023/2673 — the EU-level requirement has applied since 19 June 2026. Supervision falls to the TTJA (Estonian Consumer Protection and Technical Regulatory Authority).
What the law requires
- A clearly visible withdrawal function — available through the whole 14-day withdrawal period, without requiring a login.
- Statutory wording on the button: “Taganen lepingust” (I withdraw from the contract), confirmed with “kinnitan taganemise”.
- A plain-language declaration form and an instant confirmation on a durable medium (email) with a timestamp.
- Evidence of every withdrawal kept for the authority or a court.
What the TTJA will inspect
The authority has announced inspections of online stores for the second half of 2026. If the button is missing, the consumer's 14-day window extends automatically to up to 12 months + 14 days, and fines under the Modernisation Directive 2019/2161 can reach 4% of turnover.
