What § 356a BGB requires

- Confirmation of receipt on a durable medium (email), without undue delay, with date and content of the declaration.
The German twist: Abmahnung risk
Germany is the only large EU market where competitors and consumer associations routinely enforce consumer law privately. A missing withdrawal button is a UWG competition-law violation that can trigger an Abmahnung — a formal cease-and-desist letter with legal costs typically between €800 and €2,500, plus a contractual penalty on repeat. The first Abmahnung waves for missing withdrawal buttons were announced for autumn 2026.
Penalties beyond the Abmahnung
- The consumer's 14-day period can extend to 12 months + 14 days.
